Overall consumer credit quality is showing some signs of improving, after the economy grew at a blistering 6.1 percent annualized pace in the second half of last year.
Delinquencies on installment loans, like auto loans, fell in the fourth quarter to the lowest level since 1995, the American Bankers Association said on Tuesday.
Delinquencies on mortgages fell in the fourth quarter to their lowest levels since 2000, according to the Mortgage Bankers Association. Bankruptcy filings also fell in the fourth quarter from the year before, the first decline since the end of 2000, according to the Administrative Office of the U.S. Courts.
But with the labor market still struggling, consumer credit has not fully recovered. In the fourth quarter, credit card delinquencies jumped to a record high, according to the American Bankers Association, and mortgage foreclosures rose, according to the Mortgage Bankers Association.
Credit card payments are likely to be the last loan area to improve, because a hard-up consumer will first stop paying off unsecured debt like credit card borrowings. Stopping payments on a car or a house is usually a last resort.
``If people have limited funds, they're making the right decision to pay off their secured debt before they pay off their unsecured debt,'' said Todd Mark, a spokesman for Consumer Credit Counseling Service of Greater Atlanta, a nonprofit which helps people who have trouble paying their bills.

NEW YORK (AP) -- Confident that the growing economy will keep their jobs secure, American consumers continue to charge up a storm. But a growing number are also mailing their payments sooner, or even paying off their balances.
A persistently growing economy has increased employment, and card issuers say they have tightened lending standards, resulting in the lowest level of delinquent credit card accounts since the fall of 1994, the American Bankers Association said Tuesday.
"I think this is an important improvement," said James Chessen, chief economist at the ABA. "The vast majority of consumers are using credit responsibly. Almost 97 percent of credit card accounts are paid on time."

Increasing consumer debt - $704 billion as of April - is driving people to bankruptcy, counselors and consolidators, as well as to programs such as Oprah Winfrey's much-publicized "debt diet."
The number of credit counselors licensed by Wisconsin has grown by 30 percent in the last three years, jumping from 78 in 2003 to 101 as of last week, said Jean Plale, director of licensed financial services for the Department of Financial Institutions.

Study predicts doubling of e-transactions by decade's end
The annual number of electronic payment transactions worldwide is expected to double by 2009, from 210 billion currently, according to a study sponsored by ACI Worldwide and conducted by Global Insight. Transactions are growing at a compounded annual rate of 12.9%, which is four times the expected growth in real gross domestic product. The greatest growth is expected in Eastern Europe and the Asia/Pacific region.

NEW HAVEN, Conn. -- Organizations representing thousands of attorneys are challenging the nation's tough new bankruptcy law, saying it illegally restricts the advice lawyers can give and makes it harder for clients to navigate the bankruptcy system, The Associated Press reported.
A lawsuit filed in U.S. District Court in Hartford, Conn., on Thursday claims that the law treats attorneys the same as unlicensed document preparers or credit counseling firms, which are required under the new law to give specific advice -- including not to go deeper into debt, the AP reported.
That illegally hampers the attorney-client relationship, the lawsuit argues, and might even prevent lawyers from recommending that clients hire them in the first place. Attorneys say legal advice isn't one-size-fits-all, the AP reported.

Abstract: In this Article, Professor Nathalie Martin examines societal attitudes toward debt and financial failure in the context of two global trends, the liberalization of bankruptcy and insolvency laws, and the increased availability of consumer credit around the world. The Article begins with a description of the history of the U.S. economy, its risk-oriented capitalist ethos, its consumer culture, and its resulting consumer and business bankruptcy laws. The Article next briefly addresses the personal bankruptcy systems of Continental Europe, noting that in some places, U.S.-style bankruptcy systems have been enacted but not necessarily accepted. Professor Martin then discusses Japanese and Chinese cultural attitudes toward debt, and briefly discusses new laws being proposed or passed in Japan, Hong Kong, and mainland China, some of which are based in part upon U.S. laws. Based on this and other examples, she concludes that cultural attitudes play a tremendous role in the efficacy of bankruptcy and insolvency systems. She further concludes that, as more and more consumer and business credit becomes available around the world, the countries affected will need to enact effective and accepted discharge and fresh start principles, but that these systems cannot simply be transplanted from the United States. Such transplantation is likely to be ineffective and thus gradual education and changes in laws and credit availability will be needed in order to avoid the extensive social costs that could result from too much credit in systems that do not accept financial failure.

Lawsuit challenges new bankruptcy law
MAY. 12 12:36 P.M. ET Organizations representing thousands of attorneys are challenging the nation's tough new bankruptcy law, saying it illegally restricts the advice lawyers can give and makes it harder for clients to navigate the bankruptcy system.
A lawsuit filed in U.S. District Court in Hartford on Thursday claims that the law treats attorneys the same as unlicensed document preparers or credit counseling firms, which are required under the new law to give specific advice -- including not to go deeper into debt.

"Someone could be down and out but have access to a student loan to go to school for retraining," said attorney Barry S. Feigenbaum, who filed the suit. "We couldn't advise that client to take that student loan."

If the Federal Reserve raises interest rates at the end of June, as seems probable, it will likely be criticized for making a fetish of inflation and, in the process, risking an American or global recession. There are already signs that the U.S. economy is slowing. Stock markets around the world have declined sharply. Why should the Fed make matters worse by nudging up rates even a tad? This is a sensible-sounding complaint. Based on what we now know, it's also wrong.
We have an inflation problem that we need to cure before it gets worse. A central lesson of the past half-century is that inflationary psychology, once embedded in price- and wage-setting practices, is stubborn and destructive. It leads to frequent recessions. It stunts the rise in living standards. People detest it. They're frightened by rapid and unpredictable price changes. We learned these lessons the hard way. From 1960 to 1979, inflation rose from 1.4 percent to 13.3 percent. Only the horrific 1980-82 slump (peak monthly unemployment: 10.8 percent) repressed it.

Today’s teenager has expensive tastes — they want the newest and the best of everything. In short, they’re the perfect target for marketers. Last year, teens spent about $160 billion dollars on clothing, music, technology, food and entertainment, according to marketing research. And one out of every 10 teens uses a credit card. By the time a student enters their freshman year of college, their average debt on a personal credit card is about $1,500. Vera Gibbons, contributing editor for Kiplinger's Personal Finance magazine, was invited on “Today” to tell parents how they can help their children control their spending.

College students are the largest identifiable segment of first-time customers for credit-card issuers. Credit-card companies will be on campuses rolling out their credit card offers and free T-shirts before classes even begin. These offers work well. According to a 2005 survey by the Jump$tart Coalition, 45 percent of college students are currently in credit-card debt, with the average debt totaling $3,000.

Number of bankruptcy filings increase as limits loom

Debtors are crowding into local bankruptcy courts to file for Chapter 7 liquidations before a new, more restrictive federal law takes effect.
There were 3,644 Chapter 7 filings in Los Angeles and the San Fernando Valley in May, up 32 percent from May 2004. The jump in the mostly individual filings comes despite low interest rates and generally favorable economic conditions.

Bankruptcy law gets tough on debtors: latest legislation seeks big payback for creditors

For decades, declaring bankruptcy has been a last-resort measure to re-establish financial standing for economically distressed individuals and families. Now, a new, controversial law--the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005--will make it harder to seek protection under Chapter 7 of the bankruptcy code, which eventually erases most unsecured debt after a surrender of some resources. Most provisions of the bill, which was signed into law by the president April 19, will take effect Oct. 17.

Tougher test for bankruptcy: new law makes filing Chapter 7 more costly and complicated.

If you've been thinking about filing for bankruptcy, perhaps you should think again. The newly enacted Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 went into effect October 17, and among other stipulations, it forces many who would file for Chapter 7 bankruptcy to instead file for Chapter 13 bankruptcy and commit to a payment plan.
For consumers struggling with credit card and other debt, the new law places more pressure on them to settle their debts instead of seeking a "new start" through bankruptcy. While the bill is intended to curtail bankruptcy abuse from debtors who can afford to pay their creditors, Arlene Gordon Oliver, a partner at Rattet, Pasternak & Gordon Oliver L.L.P. in Harrison, New York, says the bill amounts to "indentured servitude."

The last time the U.S. savings rate was negative was 1933. The unemployment rate hit 25 percent, and more than 4,000 banks had closed.
It's hard to save money when you're selling apples on the corner.
In 2005 and so far in 2006, the savings rate is negative again -- we're spending more than we're saving. Unemployment is 4.7 percent, and the stock market is up almost 29 percent since the dark days of September 2001.
It looks like we're doing OK -- at least better than we were in the Great Depression.

I remember when I was a young man, I ran up a several hundred dollar credit card balance, and like most of my friends, I made the minimum payment each month and didn’t think a lot about it. That was what everyone I knew did. Finally, I decided I wanted to pay off the balance and get rid of the monthly payment. I started paying an extra amount with each payment, but every time I would get to the point where I could pay it off in the next couple of months, something unexpected would come up, and I would have to put it on my credit card. It was frustrating.

Are you in a SQUEEZE & BULGE situation in your financial affairs? Let me illustrate. Your net income is $3,000 monthly. Your rent, car payment, food and other monthly expenses is about $2,800, leaving you $200 of disposable income. However, you owe $30,000 of credit card debt. You need $1,000 monthly to keep your credit cards current. So, you’re short $800 a month. What do you do to keep your credit cards current? When $100 is due on one card, you pay that off. When another $100 is due on another card, you also pay that off. That wipes out your disposable income of $200. You’re able to put the SQUEEZE on two cards, which require a minimum of $100 each. But what is happening to your other credit cards? They are BULGING out. You have five other cards that require another $800 a month. That’s the BULGE. Thus, you’re able to SQUEEZE out $200, but even as you are able to SQUEEZE the two cards, you are unable to pay the $800 BULGE of the other five credit cards. Every month you play this game of SQUEEZE & BULGE with your credit card debt.

Maintaining an Optimal Balance
Once solely restricted to the wealthy, now almost any one can obtain a credit card including the most favored, first year college students. It's no wonder then that U.S. consumer credit card debt stood at over $735 billion in 2003 which further breaks down to approximately $12,000 per household for those who elected to carry balances from month to month. While the advertisements of the Visas and MasterCards of the world continue to tout the convenience and ease at which you can shop or handle an emergency with just a swipe of the plastic, they fail to mention how you as a consumer should use your card including guidelines as to how much credit limit is too much and how to keep from ruining your credit rating by constantly maxing out your credit card. The purpose of this article is to provide you with some insight in these two areas.
When you apply for a credit card, one of the first things you consider is the credit limit. Why? Because that determines how much you can spend, and the rule of thumb is the higher the limit the better. But wait a minute, just because your limit is $3,000 doesn't mean that you should keep spending until it's gone. Why? There are two simple reasons why you should not spend until your card has reached the limit. The first reason being that the higher your outstanding balance the higher your minimum monthly payment. Once your card reaches the limit unless you start to pay a significantly higher monthly payment to get it down, the interest charges and over-the-limit fees will begin to kick in which will cause someone who is living beyond their means to become overwhelmed very quickly. Even worse if you have more than one card that is at the limit, you are playing a dangerous game because any major disruption in employment or income that you can't supplement with personal savings or credit insurance will negatively affect your credit score instantly. Secondly, future creditors also consider your debt to income ratio when deciding whether to extend additional credit to you. Ideally you want this to be as low as possible considering you never know when you might need additional credit. A debt to income ratio of 36% or less is most favorable.
So what is the ideal balance for someone with a credit limit of $3,000? Ideally, potential creditors only like to see 25% of your total available credit outstanding at any given time. So, with a $3,000 limit you should only carry a balance of approximately $750. I'm not saying you can't purchase more than $750 worth of items at any one time, what I am saying is that if you must make major purchases you should commit to paying significant amounts of money each month to bring your balance back down to this more reasonable level before charging again.
